We, ProEves Services Private Limited (“Company”, “ProEves”, “we”, “us”, “our”) assist parents discover and book preschools, daycares after school programs, events and activity classes for their child (“Services”). We have developed and operate the website www.proeves.com (“Website”). This Privacy Notice applies to both retail customers using the public website and corporate users accessing the dedicated corporate portals.

We respect data privacy rights and are committed to protecting Personal Data received by us. This privacy notice (“Privacy Notice”) describes how we collect, use, share, protect and store your Personal Data received through our Website.

Unless otherwise set out below, each capitalized term in this Privacy Notice shall have the meaning as set out in the Terms of Use.

1. KEY DEFINITIONS

  1. “Customer” shall mean a corporate entity which avails our Services for its employees.
  2. “Corporate User/s” shall mean and include the employees of the Customer.
  3. “Controller” means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of Personal Data.
  4. “Personal Data” means any data about an individual who is identifiable by or in relation to such data, (including but not limited to the user’s first name, last name, mobile number, residential address, email address, company name, company email, company name and designation).
  5. “Processor” means a natural or legal person, public authority, agency or other body which processes Personal Data on behalf of the Controller.

2. PERSONAL DATA COLLECTION

We may collect Personal Data in the following ways:

  1. Personal Data collected through Website: We may receive Personal Data when you visit our Website, including but not limited to full name, email address, contact number and any other information you share with us.
  2. Communications: We may collect information that you provide to us when you contact us to inquire about our Services or Website. Such information may include your first name, last name, email address, phone number and any other information you provide, including your interests in relation to our Services or Website. We use this information to communicate with you about your inquiry or interests and schedule a demo of our Services and Website.
  3. If ProEves receives Personal Data from Customers, ProEves shall act as a Processor and the Customer shall be the Controller. ProEves will process such Personal Data only as per the instructions received from the Customer. For Personal Data processed by ProEves on behalf of Customer, please refer to clause 3 of this Privacy Notice.

3. PERSONAL DATA PROCCESSED ON BEHALF OF THE CUSTOMER

This section concerns the Personal Data of the Corporate Users collected by the Customer and shared with us.

  1. ProEves as a Processor: The Customer sets the purpose and means of processing of such Personal Data. We process such Personal Data only on behalf of and on the instructions of the Customer and for the purposes of rendering our Services to the Customer.
  2. Customer Privacy Notice: If you are a Corporate User and your Personal Data was shared with us by the Customer, the privacy notice of the Customer shall be applicable. This means that any enquiry, request, objection or complaint that you as a Corporate User may have in connection with the collection and/or processing of Personal Data that forms part of your Website usage should be addressed to and resolved by the Customer.
  3. Personal Data: Depending on the nature of services and Customer requirements, we process Personal Data on behalf of Customer/s. We may process Personal Data including but not limited to the Corporate User’s full name, mobile number, residential address, email address, company name, company email, child’s age.
  4. Further, the Personal Data processed on behalf of the Customer may differ based on the specific requirements, we remain the Processor and the Customer is responsible for providing adequate privacy notices.

    The Customer has complete control over the Personal Data and ProEves processes the Personal Data on the Customer’s behalf. We will process the Personal Data for as long as we provide services to the Customer and the Customer maintains active accounts of such Corporate Users.

4. COOKIES

We use cookies and/or similar in-house and third-party tracking tools to track user traffic patterns. Tracking tools also used are beacons, tags and scripts to collect and track information and to improve and analyse our Website. You may choose to disable cookies through your browser setting however, this may affect the functionality of the Website.

We may use cookies to:

  1. Analyse web traffic and improve site structure, design, content, and functions.
  2. Check if you’re signed in to the website.
  3. Test content by showing different versions to different users.
  4. Store preferences for personalized content.

5. CHILDREN’S PRIVACY

We do not collect Personal Data from children under the age of 18 years. If the legal representative of the child discovers that the child has provided us with Personal Data, we request the legal representative of the child to contact us at privacy@proeves.com to have the Personal Data deleted.

6. ACCURACY OF INFORMATION

The User shall solely be responsible for the accuracy, correctness, or truthfulness of the Personal Data shared with us whether of its own or any third party. In the event the User is sharing any Personal Data on behalf of a third person, the User represents and warrants that he has the necessary authority to share such Personal Data with the Company, obtaining written consent from such third party and the Company shall not be responsible for verifying the same. The User understands and acknowledges that such Personal Data shall be subject to the terms and conditions of this Privacy Notice.

7. HOW WE USE PERSONAL DATA

We may use the data for the following purposes:

  2. ii. for the creation or development of business intelligence or data analytics in relation to the services provided by us (for this purpose we may share the Personal Data with certain software or tools available online),

We will retain User’s Personal Data as long as it is required to be retained for the purpose of provision of the Services. We may also retain and use User’s Personal Data as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

We are committed to maintaining information security and protecting Personal Data from potential breaches. Although we provide appropriate firewalls and protection, we cannot warrant the security of Personal Data transmitted as these systems are not hack proof. Data pilferage due to unauthorized hacking, virus attacks, technical issues is possible, and we will take necessary measures to mitigate such events.

We maintain annually audited security measures aligned with ISO 27001 standards. You agree to immediately notify the Company in writing by email to privacy@proeves.com of any unauthorized use of your account or any other breach of security.

11. YOUR PRIVACY RIGHTS

You have the right to access Personal Data in our possession, right to have us rectify or modify any such Personal Data, right to have us erase/delete your Personal Data, right to nominate, right to withdraw consent at any time where we are relying on consent to process Personal Data. Depending on the nature of the request, we may ask you to complete a Personal Data request form or seek certain details to verify the request. You have the right to approach the relevant data protection authority after you have exhausted your right to approach the Company to have your grievance/ concern addressed.

14. GOVERNING LAWS

This Privacy Notice shall in all respects be governed by and construed and enforced in accordance with the laws of India and the competent courts in New Delhi, India shall have an exclusive jurisdiction to adjudicate any subject matter under this Privacy Notice.
